How To: Transfer Land Title in the Philippines
Date Ended: June 29, 2010
This is a personal account of how I transferred a land title in my name. I hope it can serve as a guideline so you will not be at loss in the whole process.
I started my date when I had the DEED OF ABSOLUTE SALE notarized. The notarization fee is usually 0.1% of the amount stated in the Deed of absolute Sale.
I proceeded the next day to the Bureau of Internal Revenue (BIR) to get the check list and assessment of Capital Gains and Documentary Stamp. I had to make an amended return 22 days after because the Revenue District Officer miscalculated the zonal value. Zonal value is higher when you are transferring a unit in a subdivision or a unit in a condominium.
NOTE:
You will have a HIGHER zonal value, If you put the subdivision/townhouse/condominium name on the DEED OF ABSOLUTE SALE as opposed to just writing the the number and street name. It's a hundred thousand peso mistake. Cost me a lot of KACHING KACHING! But the Revenue District Officer did his job by going to the site. Walang lusot!
Go to Bureau of Internal Revenue to acquire CERTIFICATE AUTHORIZING REGISTRATION (CAR)
TIN of seller BIR Form No. 1904
TIN of buyer BIR Form No. 1904
Notarized Deed of Absolute Sale
-Attorney's fee is usually 0.1% of the selling price
-You will need to present a photocopy of government issued IDs (passport, etc.) of seller and buyer
-make 8 copies
Certified True Copy (CTC) of the latest TAX DECLARATION issued by the Local Assessor's Office (Municipal Hall) for LAND and IMPROVEMENT relevant to the date of transaction
-pay PhP60 processing fee each; make 2 copies (Start/End Date April 5; same day)
ORIGINAL- Transfer Certificate of Title (TCT)
-get Certified True Copy from Registry of Deeds (Start Date April 6; End Date April13)
-pay PhP160 per copy; make 2 copies
Official Receipt/ Acknowledgment Receipt as proof of payment
-no O.R., type a simple acknowledgment receipt
Certified True Copy of Title from Registry of Deeds (RD)
Pay Capital Gains Tax Return BIR Form No. 1706 to nearest UCPB or any bank accredited by BIR
-6% of the selling price or zonal value whichever is higher
-Zonal value will be assessed and computed by a Revenue Officer. Once computed, you will have to pay within 60 days time frame or you will be penalized. (Start Date April 7; Amended April 29)
Pay Documentary Stamp Tax BIR Form No. 2000-OT to nearest UCPB or any bank accredited by BIR
-1.5% of the selling price or zonal value whichever is higher (Start Date April 7; Amended April 29)
Zonal value can be viewed and computed here.
Photocopy everything in 3 sets, 2 sets will be submitted along with some original to BIR
Pay PhP100 Certification Fee and PhP20 Documentary Stamp (BIR) (April 15)
Submitted all the requirement including the amended return on April 29. After daily follow up, I finally got my Certificate Authorizing Registration (CAR) on May 20, 2010.
NOTE:
As in dealing with every government agencies, your patience might be tested from time to time. You just have to put on your best smile and move ahead. Oh, oh! I hope this will all change with the new President leading this country, P-NOY!

ORIGINAL Deed of Absolute Sale
ORIGINAL Tax Clearance Certificate from Municipal Hall
- Pay PhP50 (Start/End Date May 20; same day)
ORIGINAL Transfer Tax Receipt from Assessor's Office Municipal Hall
-5% of the selling price or zonal value whichever is higher (same day)
ORIGINAL BIR Certificate Authorizing Registration (CAR)
ORIGINAL Capital Gains (BIR Form No. 1706), Documentary Stamp (BIR Form No. 2000- OT) with receipts
ORIGINAL Transfer Certificate of Title
CTC of Tax Declaration of Real Property
Pay the computed REGISTRATION FEE to RD
While at the Registry of Deeds and upon getting the Transfer Certificate of Title (TCT), make 2 copies each of Certified True Copy- DEED OF SALE PhP169, CAR PHP169 and TCT PHP160.
What was supposed to be a week's wait turned out to be a month. I got my Transfer Certificate of Title on June 16.
NOTE:
Original Receipt is given when you received your document that you have already paid a week or two before. Nevermind what is stated in their assessment form that your Original Receipt should be given to you right after you made your payment. That's how it works! And what can be done in a few minutes time, like printing of documents, would be scheduled for pick up in a week or two. In my case, a month long wait due to the people who needed to sign the document! I pity those people who have to shuttle back and forth and miss their job from endless follow up! Not counting the LUNCH BREAK in between.

- show the ORIGINAL Transfer Certificate of Title
CTC of the latest TAX DECLARATION issued by the Local Assessor's Office (Municipal Hall) for LAND and IMPROVEMENT relevant to the date of transaction

Last June 22, I spoke with the assessor, she told me that the house was already assessed and found out that there was an attic. The last time it was assessed, only two floors were declared. Geez, now, my annual tax declaration will be over PhP3, 000 more than what the previous owner was paying.
June 29, I finally got my TAX DECLARATION. The computation IS assessment of land and improvement multiply by 2.5%. The sum of your land and improvement assessment is your annual tax declaration.
NOTE:
Mind you, the attic only measures 30sqm. If I had known not to let the assessor inside the house or better yet not to let him go upstairs hehe But they are very diligent like that, sending representative to your house to check on the improvement/ location. Much like what the Revenue Officer did by visiting the exact location of the land and reassessing its zonal value.
To finalize this blog post, I learned that you can have business transaction with the government without any bribe or red tape. You will just have to have patience and perseverance, two very important virtues, in dealing with them. In time, mine took over two months, your documents should be ready and available. I don't know if the process varies though in other cities around the Metro.

Gud am, ma'am i like to know if what city did u transact ur transfer of land title? coz right now it took me a month and a half and still transfer of land title to my name still not yet done. customer service in RD caloocan sucks..

Patience is a virtue. You have to kiss ass and be meek as a lamb when dealing with these so called government employees. I know taxpayers pay for their salaries but our papers' approval are within their hands. What can we do with bureaucracy!

Hello po! Yung bahay na inuupahan namin sa isang small subdivision, ay malapit nang mailit ng pag-ibig. Itatransfer po samin ng agent para kami na ang bumili. And worth is 350K. Sabi nung agent, ung title hindi pa nakapangalan sa may-ari nung bahay. Kung gusto daw namin, magbayad kami ng 120k para samin na diretso ipangalan. Is the price reasonable?

Your post is nearly two years old; nonetheless it's the most useful one I found on this subject kasi it's not theoretical but recounts your actual experience. So, thank you! Question, though: Around how many actual man-days did you have to devote to this task? I'm actually deciding now between doing this myself for a property I had purchased (I have the title and deed of sale, but not yet notarized), or allowing the property developer's office to do it -- They gave me a tag price of more than P30,000. So I'm trying to do a cost-benefit analysis, kasi if I'll actually have to be on leave from work more than 20 days for this, baka sulit na nga lang to have the developer do it.
@Judy Mina And Anonymous Please direct your concern to the department concerned. I merely blog about what I went through during the time I transfered our property. I am not in any way involved with BIR? Registry of Deed.
@the write project Just a few days, count the dates in green (I think 13 days more or less) The rest of the time you are just waiting for your documents to be processed. Try to haggle with the property developer to PhP15, 000.

Hi! I just recently bought a 118 sq.m. residential vacant lot and the title is ready for transfer to my name. The seller said that “if” they will be the one who will process the transfer, I will have to pay 7.5% interest to the BIR only.. Is it right that me, the buyer, should shoulder the additional 1.5% when in the BIR Form 1706 it’s only 6%? Any idea how much will it cost to transfer a title when the selling price is P378,000? So I would just process the transfer myself. Please help… Thank you!
@Tin Hi You better check with the BIR district where you bought your land. That way the amount would be assessed correctly.

I have same issue kaya lang my problem is yung title is issued thru CARP then naka specify sa title "...the subject to the condition that it shall not be sold, transferred or conveyed except through hereditary succession..." and I'm not an heir. I am planning to buy the land, kaya lang baka di pwedeng I transfer yung title. Any idea?

hi ,may tanong lang po ako ,nakabili po ako ng lupa sa probensya namin, na sunod po ang lahat na legal papers. ang huli po ay yung sa assessor office . ang problema yung unang may ari ng lupa na nabilhan namin ay humuhinge ng pira para sa pipirmahan yang papel, may karaptan po ba sya mag pabayad ng pirma nya kahit na nabili namin?

Mrs. Martinez, I would just like to thank you for posting this blog for this is what helped me a lot and guided me in successfully transferring to my name the title of a property that i bought. To those who might be wondering, parehong-pareho pa din po ang mga documentary requirements and process as what Mrs. Martinez posted, siguro po ay may konting pagkakaiba nalang kung lot lang or house and lot or ipapasu-subdivide pa yung lot. And also as what Mrs. Martinez said, mag-baon po kayo ng maraming-maraming pasensya at pag-pupursige at sigurado pong masusubok iyan ng ating mga butihing gov't employees. Good luck po dun sa mga mag-sstart palang mag-ayos and thank you again Mrs. Martinez!!!

...so as not to cost me a lot of moolah, I will be honest to indicate the subdivision name in the Deed of Sale?

@Anonymous It will cost you a lot more if the land is within a subdivision. The RDO will conduct an ocular inspection of the site. Whether you indicate it or not, the payment will still be the same.

Hi ask ko lang po. Ilang months na lang po matatapos na po ang hinuhulugan kong lote lang for 5 years. Ngayon ko lang po nalaman sa kanila na ako pa pala ang magbabayad sa pag transfer ng title? Hindi naman po sinabi sakin from the very start. Ang napag-usapan lang ay ang contract price. Legal po ba yong ginagawa nila na ako pa ang magbabayad sa pag transfer ng title? salamat po.

@Anonymous I don't know about the legalities. You might want to cosult a lawyer with regards to the matter you are asking. However, you can double check first what is written in the contract.

@Mike I processed the papers that is under the name of my uncle. The important thing is that he will be willing to sign the documents that needed his signature.

I bought my property(336 sq.meter) and my 2 niece wanted to buy the 2 parts w/c is 84 sq. mtr each.
I already have the Orig'l TCT from the owner & deed of absolute sale notarized. we want to have a separate TCT for 3 on this whole 336 sq.mtr LOt.
What will be the first thing i needed to do? Is it same procedure as yours? do i need to have a survey first so i can get the technical description for each lot title? as of now, a surveyor from the city hall offered his service and asking for a Php 7,000 for each survey. that will cost Php 21,000. Is it fair or i can hire a private surveyor even from outside cityhall? and can i also ask if there is an expiration for the deed of absolute sale that i already paid? becAuse my agent said, i'll be penalized because of that?

Hi, mrs. martinez. Waht do you make 2 or 3 copies in some documents, is it xerox copies or you mean original copies? Ex: tax declaration 60 per copy? make 2 copies> do you mean to xerox 2 copy or to request 2 original of it, 60x2=120?
Same case...owner is asking me to oay 95k plus 12% of the total contract price...

If we will start the transfer process in BIR by Feb 6, when do you think can we complete it (provided all docs and payment to BIR are ready)?
Are they giving an entry number that the process of transfer/registration is already on-going. When will this take place?

You only have to pay what's written in the contract that's why it is called contract in the first place.

Hello po, c mel po ito ng bulacan. Ask ko lang po, bumili kami ng lupa dito sa bulacan,Last May 2011 pa po namin binayaran sa may ari at ang nagbayad kami sa abugado ng pera para sa pagpatransfer ng land title sa pangalan ko. Ask ko lang po, gaano ba katagal ang inabot ng pag process ng pagtransfer ng land title? Kc po nagbayad kami sa pagpatransfer ng title worth 27k 2 years ago pa po. Till now hindi pa rin nila binibigay sa amin ang titulo,when i ask wala naman daw po problema sa mga papers, hindi ko po kc nakita ang mga papers kung kumpleto ba at walang problema, our mistake. That time po kc buntis ako kya kami kumuha ng mag asikaso at nagbayad kmi. bale ang kausap po ng taong nag aasikaso nun ung mismong may ari ng lupa.
